We specialise in determining rights of light infringements and advising on solutions and remedies for those affected

We will carry out an initial assessment of the relevant issues in each specific case and then partner those affected with appropriate legal and other professional advisers who will be tasked with obtaining the desired remedy for each party according to their requirements, whether this be financial compensation or otherwise.

We aim to procure that those affected by diminution of their right of light due to nearby developments or otherwise have access to redress via those appointed to assist on a no win no fee basis where this is possible so as to minimise the financial risks involved.

EXPERTISE

We are qualified to identify any legally enforceable actionable right of light issue in relation to your property, whether commercial or residential, and will, on request, provide you with an initial assessment of the remedies available and how they may be obtained in an efficient and cost effective manner. Our expertise is two-fold, namely (i) to advise developers on ways of mitigating their risks associated with new developments from a right of light perspective; and (ii) assisting those who are affected by a loss of light attributable to a new development in obtaining a solution that best meets their requirements. Our experience enables us to provide a prompt response and summary of the issues involved to any party for whom we formally agree to assist.

PROJECTS & OBJECTIVES

We have successfully advised on numerous potential or actual rights of light infringement issues on small and large value commercial developments including sizable city centre residential developments; student accommodation; and hotels with multi-million pound (£) potential compensation and injunctable issues for various different parties, whether property owners, investors, funders, developers or tenants. In each case the issues are very similar as is the aim, namely to provide the best end result for those we are asked to assist.

KNOWLEDGE

We are constantly updating our understanding of RICS guidance/practice notes relating to the handling of Rights of Light issues and Law Commission consultation papers and reports, as well as fully understanding decided cases in this area to facilitate the provision of advice to developers and individuals alike.
